NSA SLAYER ACCUSES DOJ OF 'OBSTRUCTION OF JUSTICE'
Says Obama administration manufacturing threats to
delay of proceedings, shut down case

The attorney whose cases produced a ruling from a federal judge that
the National Security Agency spy-on-Americans program likely is unconstitutional
now is accusing the Obama administration of obstruction of justice for
demanding that the proceedings be delayed.
The Department of Justice recently moved to delay action on the cases
brought by attorney Larry Klayman, founder of FreedomWatch,
against the NSA's telephone call-tracking program.
As pato1 its reasoning, the Obama 2dmiistralion officials told-the
federal court, "Further litigation of this issue-could risk or require
disclosure of classified national security information, such as whether
plaintiffs were the targets of or subject to NSA intelligence-gathering
activities, confirmation or denial of the identities of the telecommunications
service providers from which NSA has obtained information about individuals'
communications, and other classified details of the challenged programs."
"What?" wrote Klayman, in Wednesday's opposition to the
government's motion for a stay of proceedings
"This outrageous assertion in effect amounts
to a threat against plaintiffs - suggesting that they are now under 'criminal'
investigation in obvious retaliation for plaintiffs having succeeded with their
motion for preliminary injunction," Klayman told the court. "These
threats are not only manufactured to try to shut down this case, but they also
amount to an obstruction of justice, as they are intended to scare and coerce
plaintiffs into backing away from fully litigating these suits."
Klayman argues that the district court needs to move forward on the
case soon, because the court itself had warned earlier, "We work 24/7
around this courthouse, my friend. 24/7. I don't want to hear anything about
vacations, weddings, days off. Forget about it. This is a case at the pinnacle
of public national interest, pinnacle. All hands 24/7. No excuses. You got a
team of lawyers; Mr. Klayman is alone apparently. You have litigated cases in
this courthouse when it is matters of this consequence and enormity. You know
how this court operates."
The government recently, in its motion filed to U.S. District Judge
Richard Leon, who earlier issued an injunction against the spy program and
called it "Orwellian," asked that the judge halt any further
proceedings while an appeals court examines the ruling-that said the government
was vioh&ing-the- Constitution.
Klayman said when the government motion was filed,
the move wasn't exactly a surprise in light of the government's spying on
Americans and its reluctance to provide information about the programs.
"This is a further attempt to keep information about the biggest
violation of the Constitution in American history from the American people.
It's an outrage," he said.
He said the Obama administration has the perspective of "heads I
win, tails you lose," and its attitude is: "We control all the
information and the American people be damned. They
don't have rights."
Klayman said he already had requested a status conference on the case,
asking the court how to proceed with discovery in preparation for trial.
The government move reveals its true attitude, he said.
"It's important for the American people to see how the government
treats them and views them. We're nothing more than rabble," he said.
Politico reported on the government's motion, which argued:
"Further litigation of plaintiffs' challenges to the conduct of these programs
could well risk or require disclosure of highly sensitive information about the
intelligence sources and methods involved – information that the government
determined was not appropriate for declassification when it publicly disclosed
certain facts about these programs."
The information actually was disclosed when former
NSA contractor Edward Snowden leaked details of the program.
The DOJ argued that if the litigation proceeds, "it will
ultimately become necessary to conclusively determine, as a factual matter,
whether plaintiffs have established their standing to challenge NSA' s alleged interception of the content of their
communications, and collection of metadata about those communications."
Klayman said the aim of the lawsuits is to find out the details of the
programs and whether the government, in its alleged pursuit of information
about terror activities, has been violating the constitutional assurances of
Americans' privacy.
The government is alarmed at that aim.
"Plaintiffs have indicated in their pleadings (and during argument
on their motions for preliminary injunctions) that they intend to pursue
discovery to obtain 'full disclosure and a complete accounting' of what the
government defendants (and other defendants in these cases 'have done [or been]
allowed to do' in connection with the challenged NSA intelligence programs;
'identification of any and all 'targets' subject to defendants' 'surveillance'
and production of 'all other relevant reports, risk assessments, memoranda, and
other documents," the government said.
In his argument against delay, Klayman noted that the NSA already
delayed filing a notice of appeal for three weeks after the court emphasized
the need for quick work on the case.
And he noted the NSA, after the judge's ruling, went back to the
"secret star chamber proceedings" of the Foreign Intelligence
Surveillance Court and obtained permission
to continue its spy programs.
"It is clear that the NSA defendant, despite this court's ruling
of gross unconstitutionality, is continuing to violate, in an egregious
fashion, the Fourth Amendment rights of over 300 million Americans,"
Klayman said.
"It is telling that while trying to throw a monkey wrench into and
effectively shut down plaintiffs' cases, the NSA defendant has the audacity to
argue that the court should allow these cases to go forward only as the NSA
defendant sees fit ..."
WND has reported in the case that Klayman also charged he was put under
surveillance – and more – by the agency when he filed the case.
Klayman, a WND commentary contributor and founder of Judicial Watch
and, more recently, FreedomWatch, told WND that once
his allegations that the federal government was violating the Constitution with
its "watch-every-call" strategy hit the courts, he noticed problems
with his email.
"People began receiving from me emails that I had never
sent," Klayman told WND at the time, suggesting harassment in response to
his work. "The government just wanted me to know they were watching
me."
Klayman filed the action on behalf of several
plaintiffs, seeking first a preliminary injunction to prevent the federal
government from damaging Americans further. Leon wrote, "I cannot imagine
a more 'indiscriminate' and 'arbitrary invasion' than this systematic and
high-tech collection and retention of personal data on virtually every single
citizen for purposes of querying it and analyzing it without judicial
approval."
Klayman brought the case on behalf of Charles Strange, the father of
Michael Strange, a cryptologist technician for the NSA and a support personnel
member of Navy SEAL Team 6.
Michael Strange was killed in Afghanistan when
his helicopter was shot down in 2011.
Charles Strange, as a subscriber of Verizon
Wireless, brought the case against the NSA, Department of Justice and several U.S. officials, including
President Obama and Attorney General Eric Holder.
The complaint alleges the government, with the participation of private
telephone companies, has been conducting "a secret and illegal government
scheme to intercept and analyze vast quantities of domestic telephonic
communications."

Lawsuit Attorney: Ignore White House Panel
Larry
Klayman says he's horrified by suggestion that 'fat and happy' firms take over
from 'in our underwear' NSA

Larry
Klayman, the former Reagan administration prosecutor who won a preliminary
injunction Dec. 16 against the government's collection of all American phone
records, says the
White
House's surveillance review panel should be ignored.
The five-member panel
released a 303-page report Dec. 18 containing 46 recommended changes to
intelligence practices.
"It's a ruse,"
Klayman tells U.S. News. "This is an age-old government practice: When
caught with their hand in the cookie jar, they come up with a 'solution.'"
The practice is somewhat-similar to advocating a law outlawing murder after
killing someone, he says.
Klayman expects Department
of Justice attorneys to file an appeal within a few days challenging the legal
victory he received from U.S. District Court Judge Richard Leon against the
National Security Agency's collection of phone records.
Leon's ruling was the first
major legal blow against the NSA following leaks from Edward Snowden that began
in June. Another U.S. District Court judge, William Pauley of New York, is considering an
injunction request against the phone program as part of a case brought by the
American Civil Liberties Union.
Klayman says he may seek
to skip over the U.S. Court of Appeals for the District of Columbia and take the government's
appeal of Leon's injunction directly to
the U.S. Supreme Court.
The White House panel
released its suggestions two days after Leon's ruling, and President
Barack Obama said Friday he will consider them and reach a decision sometime in
January on which ideas—if any—he plans to implement.
One suggestion from the
panel is that the NSAs collection of all American
phone records be discontinued and replaced with the voluntary
two-year-or-longer retention of those records by phone companies. The records
could then be acquired in non-emergency cases by court order.
Michelle Richardson,
legislative counsel with the ACLU's Washington Legislative Office, tells U.S.
News such a measure might eliminate an important "de facto civil-liberties
protection" by making the data available for civil and criminal cases when
it otherwise might not have been.
"1
share the same concern, if not horror," Klayman
says. "You cannot trust Verizon and the
other companies."
He points to the Foreign Intelligence
Surveillance Court order leaked by Snowden
to The Guardian in June, which compelled Verizon
Business Network Services to secretly and continuously hand over to the government
metadata on all phone calls it processed.
"The order by Judge
[Roger] Vinson could have been appealed by Verizon,"
Klayman says. "[But] they just rolled over, they didn't care."
Klayman says phone
companies are "fat and happy" from government contracts and cannot be
trusted to protect Americans' privacy.
If Obama does end or
modify the NSA phone program as cases against it are pending, Klayman believes
the cases would continue.
The conservative activist,
who founded the legal watchdog groups Judicial Watch and Freedom Watch, says he
has had unusual experiences with technology as he sues to stop the NSA
programs.
When he checked his email
using a smartphone Sunday, he says, "I was getting old emails on Yahoo
going back six years—they were popping up six years out of date. [It was] very
strange." Klayman made similar claims during a Nov. 18 hearing in Leon's courtroom, saying text
messages were sent from his phone without his knowledge.
Klayman says Leon was courageous to issue a
preliminary injunction against the NSA, which "can crush you whenever it
wishes.'
The seasoned legal
activist says he felt numb when Leon—whom Klayman called "an American
hero"—issued a thorough denunciation of the "almost-Orwellian"
phone program.
"I couldn't quite take
it all in, in many ways:" he says. "I was elated and it finally
dawned on me that this could be the biggest decision against the government in
the history of litigation."
Leon ruled the government is
almost certainly violating the Fourth Amendment rights of Americans. He ordered
the government to end its phone metadata program and destroy its five-year
stash of data, but stayed implementation of the order pending appeal.
Although Leon rested his injunction
decision on Fourth Amendment grounds, Klayman expects to prove at trial that
the NSA'S phone-record collection also violates the First Amendment, leaning on
Supreme Court precedent against actions that may chill Americans' freedom of
assembly.
"It's like a double-barrelled shotgun—we have the First and Fourth amendments
here: "he says, adding "and the Fifth because there was no due
process at the Foreign Intelligence
Surveillance Court:"
Leon did not grant a
preliminary injunction for Klayman's companion
lawsuit against the NSA's PRISM Internet program, which according to documents
leaked by Snowden gives the NSA direct access to the servers of nine major
companies, including Apple, Google, Microsoft and Yahoo. But Klayman's confident about invalidating that program, too.
"The PRISM program is
equally as unconstitutional and potentially more invasive:" he says.
"It's been revealed over the last several weeks the [NSA is] into social
media, porn sites and Xbox?"
"They're
in our underwear, essentially:" he says. "This is even more
egregious."
Outside of court, Klayman
is promoting what he calls a peaceful "Second American Revolution" to
remove Obama from office. He announced Nov. 19 the president had until Nov. 29
to resign. Because he did not, Klayman now plans to host a convention in Philadelphia that will elect a
"government-in-waiting." The date of the convention has not been
scheduled.
Leon's ruling "makes
[peaceful revolution] even more important:' Klayman says.
"Now we have confirmation that this administration has violated in
a very serious way our constitutional rights. It's us against the government.
What the judge did is validate all the critics of this administration:"
Notably, Klayman lacks
sympathy for most congressional Republicans, whom he says "don't have the
guts" to impeach Obama. NSA surveillance supporter Rep. Peter King,
R-N.Y., "is shameless and disgraceful:" Klayman says.
Also shameless and
disgraceful, according to Klayman, is former CIA acting Director Michael Morell, one of five appointees on the White House
surveillance review panel. Morell told the National
Journal Sunday he believes the NSA should reactivate a program that scooped up
email metadata.
Klayman says if Morell—or anyone else—works
to re-establish that program, they should be criminally indicted.
"I'm not one of those conservatives who believes
the judiciary is a lesser branch of government:" he says.
